1. OBJECTIVE These General Terms and Conditions regulate the electronic purchases you make through the www.mielesanta.com website (hereinafter, the “Contract”). By pressing the “Make Payment” button at the end of the Purchase Process, you expressly accept that these General Terms and Conditions become part of the said Contracts and that you will be obligated to comply with its stipulations from then on. Mieles Anta, S.L, with registered office in C/Ermita, 32 Pol la Grela-Bens, 15008 A Coruña and tax identification number B15351620 (hereinafter, mielesanta.com) is registered with the Commercial Register of A Coruña. Mielesanta.com may modify these General Terms and Conditions of Purchase at any time. The modifications made, shall in no way affect purchases you have made before the adoption of these modifications, which shall, in any case, be governed by the General Terms and Conditions in force at their time of purchase. The customer is responsible for knowing the General Terms and Conditions of Purchase applicable at the time when the Purchase Process begins. These General Terms and Conditions may be supplemented or modified by particular clauses or special conditions referring to certain products, especially with regard to excluding rights of withdrawal, changes or returns. Please read the product information carefully to understand these particular conditions. 2. USER REGISTRATION It is completely optional to register on the website to make purchases. You can access the section for registered users with your user name and password or using any means that mielesanta.com may in each case enable for user authentication. In association with your user registration, mielesanta.com may use cookies and other similar means which enable it to record your browsing preferences and to identify you when you connect from the same device. Registration as a user of mielesanta.com is free of charge and not subject to any conditions or considerations. You can unsubscribe as a user at any time by sending an email to pedidos@mielesanta.com. Unsubscribing as a user will lead to the erasure of your personal user data and makes future online purchases impossible unless you register again as a user. 3. QUALITY OF E-PROCUREMENT SERVICES Mielesanta.com guarantees that the products marketed through the site have the same quality and services as those sold in the physical store of Mieles Anta. Mielesanta.com has made its best efforts to achieve that the presentation of the product images on the website is as close as possible to reality. Products published on mielesanta.com are accompanied by the following information: – Name of the item – Price (taxes included) – Information on different formats 4. PRODUCT AVAILABILITY If we find that any of the products included in the order are not in stock when the order is issued, we will contact you to inform you of the impossibility of delivering that item and we will proceed to pay back the corresponding amount. The above shall not limit your legal rights as a consumer. 5. PURCHASE PROCESS The purchase process consists of the following steps:
- Product selection: browse our site and click the “add to cart” button each time you want to add a product to your purchase. The shopping cart contains the name of the selected product, the format, the quantity and the price in Euros.
- Beginning of the purchase process: To begin the purchase process, please click on the “finish purchase” button. If you are not registered as a User or have not accessed the site as such, you will be asked to do so before proceeding.
- Verification of purchase details: Before selecting a payment method, you may check your purchase details and correct any errors which may have occurred when entering the data. Once you have verified your details, confirm your order.
- Payment method selection: Select the payment method you prefer and click on the “make payment” button.
At this moment the system will redirect you to the selected payment system where you can provide all necessary data for this payment method. This will be the only time you will be asked for this information. Once all necessary data have been provided and when you click on the button to confirm the purchase, the contract will be in effect for all purposes. Purchase confirmation: Once we receive your acceptance, mielesanta.com will issue a confirmation on screen which you can archive and which contains the following information:
- Order number
- Order date
- Summary of the products included in the purchase
In any case, mielesanta.com will issue a confirmation of the purchase by email within the next 24 hours. During the entire purchase process, you can consult these General Terms and Conditions of Purchase as well as find out the final price of the selected products. Once the purchase has been confirmed, the customer may not modify or cancel the order except in the cases provided for by law or in these General Terms and Conditions. 6. LIMITS ON PURCHASE AND PROHIBITION OF RESALE OR DISTRIBUTION This distribution channel is restricted to consumers or final recipients of the products, and any professional resale or distribution activity of the purchased products is therefore prohibited. 7. PRICE All prices shown on the website are in Euros and include VAT except for those addressed to the Canary Islands, Ceuta and Melilla, which will include taxes and tariffs according to the applicable provisions in each of those regions. Before the “make payment” phase, you can find out the complete and final price of your order and, if applicable, its details with the amounts of applied increases or discounts as well as shipping costs and other additional services. Despite the measures Mieles Anta takes to prevent errors, it may happen that the price of a product applied during the purchase is not the offered price or that the offered price shown on the Website is incorrect. In case such errors are found after the Contract has been entered into, this Contract will be null and void according to the applicable legislation and without limiting your rights as a consumer. Mielesanta.com will notify you about said incident as soon as it finds out about it, and if any amounts have been charged for the purchase, they will be refunded immediately. 8. PAYMENT You can pay the price of the purchased products using any of the following means:
- Debit or credit cards issued by financial institutions (Visa, MasterCard)
Mielesanta.com may have fraud control measures in place. These measures may include that, in certain cases, a transaction may be identified as fraudulent when this isn’t actually the case. If you have been affected by this, please notify us using the means of contact provided in these General Terms and Conditions. Please note also that the providers and issuers of the used means of payment may have other anti-fraud measures in place which are not under the control of mielesanta.com and which may lead to the rejection of certain types of transactions. Mielesanta.com does not have control over and is not responsible for damages which may be caused by the application of policies adopted by different payment providers and issuers. The use of a payment method owned by a third party is forbidden except in those cases where this third party has expressly authorised the use, in which case it is your responsibility to prove this authorization and you will also assume liability for any damages mielesanta.com may incur. 9. INVOICE Mielesanta.com will send you an electronic purchase receipt. If you wish, you may request an invoice by contacting our Customer Service within 30 days of your purchase. 10. DELIVERY Delivery occurs when you receive the purchased products personally or through a third party at the address indicated for shipping. For these purposes, it will be necessary for you or someone on your behalf to sign the delivery note that the shipping company provides with the product. The signature of the delivery note does not imply conformity and only serves as proof that the delivery has taken place. Therefore, your contractual rights are not affected and it does not imply your conformity with a product in bad condition. Notwithstanding your contractual and legal rights, we kindly ask you to notify us within 24 hours about any incident related to the shipping, such as the lack or loss of any of the purchased products, a damaged product, opened goods, etc., so we can deal with any incident related to the shipping of the goods. Please note that the signature of the delivery note is necessary for the delivery of the product. Therefore, you should ensure that others can receive the purchase on your behalf. Mielesanta.com does not take responsibility for the reception by another person on your behalf without due authorization when this reception is correctly made at the indicated place of delivery. The delivery includes the passing of risk and, consequently, Mieles Anta shall not be liable for any deterioration of the products, loss or theft that may occur after that moment. In case the delivery is not possible, the shipping company will cancel the contract due to impossibility of performance. The approximate delivery time is 3 to 4 working days. These delivery times may be longer for the Canary Islands, Ceuta and Melilla. However, whenever compliance with these delivery times depends on third parties, Mielesanta.com cannot guarantee delivery times that are shorter than 15 days. For the purpose of the provisions of the Revised Text of the General Law for the Defence of Consumers and Users approved by Royal Legislative Decree 1/2007 of 16 November the latter date shall be understood as the delivery date promised by Mielesanta.com. 11. FORCE MAJEURE OR UNFORESEEABLE CIRCUMSTANCES Mielesanta.com shall not be liable for the complete non-performance, improper performance or delay in performing any of its obligations when they were caused by force majeure or unforeseeable circumstances. In such cases, any possible obligations for delivery periods shall be suspended for the entire time while the force majeure or unforeseeable circumstances persist. The period will start to run again once the force majeure or unforeseeable circumstances disappear. 12. Following the provisions of article 27.3 of Law 11/1998 of 9 July on consumer protection, we inform you that complaint forms are available at the registered office of Mielesanta.com. Furthermore, there are complaint forms at our store, which are in the name of the company that owns the establishment. Mielesanta.com will resolve any complaints sent to it as soon as possible and, in any case, within one month. In the event that such a claim is not resolved in a satisfactory manner, you may access the out-of-court dispute resolution system as set out in the previous point. 13. COMPLETE AGREEMENT These General Purchase Conditions and any document they expressly refer to (such as particular clauses or specific conditions for certain products appropriately accepted by you at the time of accepting their purchase) constitute the entire Contract and replace any other agreements or arrangements that the parties may have agreed to verbally or in writing prior to the conclusion of the Contract. 14. APPLICABLE LAW The law that shall apply to the Contract is Spanish law, notwithstanding those cases where the application of the laws of other states may be mandatory.
